TERMS OF USE
This Terms of Service ("Terms") is a legal agreement, whichdescribes the terms and conditions on which GAGALE GAMES ("We") grantto an end user ("You" or "User") who accesses to the AGE OFDRAGONS: EMPIRE WAR(the "Game") or its applications for mobile devicesor other applications thereof (collectively, "Services").
Please read the Terms carefully. Please note that by accessing or usingour Services, you agree that you have read, understood, and accepted to bebound by the Terms. If you do not agree to the Terms, please promptly exit thispage and stop accessing our Services. Please note that we reserve the right, inour sole discretion, modify or revise the Terms at any time, and you agree tobe bound by such modifications or revisions hereof.
You must be at least 13 years of age to access and use our Services. Ifyou are at least 13 years of age but below 18 years of age or such other age ofmajority required for this Agreement to be binding and enforceable against youin your country of residence ("Age of Majority"), your parent orlegal guardian must establish an Account with us. Please note that byestablishing an Account with us for use by their child/ward or otherwisepermitting their child/ward access to our Services through their Account, the parentsand legal guardians guarantee the compliance by the child/ward of theobligations under this Agreement.
We do not represent or warrant that our Services will be compatible withyour mobile device or other device/equipment. It is your sole responsibility toensure that you use compatible mobile device and other device/equipment toaccess and use our Services. Please note that all fees incurred in accessingour Services (including without limitation data charges) shall be borne by you.
1. LICENSE
Subject to this Terms, we grant to you a non-exclusive, non-transferable,non-sharable, revocable, limited license to use our Services solely for yourpersonal, non-commercial use to the Services in accordance with this Agreement.You agree to use our Services only for lawful purposes, and in a way that doesnot infringe the rights of or inhibit anyone else’s use of our services. Pleasenote that we are entitled to immediately terminate this license, without anyliability to you in the event of your violation of the Terms.
Our Services comprise of content belonging to us and/or our licensors,which are protected by copyright, trademark, and other intellectual propertylaws. We hereby reserve all rights, including without limitation, intellectualproperty rights and other rights, in respect of our Services. You shall not useour Services or the intellectual property comprised in our Services in a mannerthat infringes our or our licensors’ rights.
2. ACCOUNT
If you agree to this Terms, you may install ourServices applications onto your mobile devices or other equipment for purposesof playing the Game by registering for and accessing an account with theService (the "Account"). You shall not use or access our Serviceswhich is provided or downloaded from any platform that was not licensed by us.
When your Account is opened, you may be required to choose a name toidentify yourself ("Account ID"). You shall not use as your AccountID a name which violates any third party's trademark right, copyright, or otherproprietary right, or which may mislead others to believe you to be an employeeof ours, or which we deem in our sole discretion to be offensive. You agreethat we reserve the right to change, terminate or suspend access throughoffensive or inappropriate Account ID in our sole discretion at any time. Wealso reserve the right, in our sole discretion, to delete or change yourcharacter name for certain services that we deem to be inappropriate oroffensive at any time. And you are solely liable for all activities conductedthrough your Account or under your Account ID or character name.
When your Account is opened, you must also select apassword. You are responsible for maintaining the confidentiality of yourpassword and you are responsible for any harm resulting from your disclosure orallowing the disclosure of your password or from use by any person of yourpassword to gain access to your Account and Account ID. You agree to notify usimmediately if you are aware or reasonably suspect of any unauthorized use ofyour Account or password.
Please note that your account is for your personal use only. Youspecifically agree not to: (1) share your account credentials with anyone else,(2) sell, offer to sell, rent, lease, trade or otherwise transfer your accountto anyone else for any reason, (3) sell, offer to sell, rent, lease, trade orotherwise transfer any "Gold" or other virtual currencies, gameresources, in-game services like "speed-ups," or other in-game itemsassociated with your account (collectively, "In-Game Items"), exceptby using mechanisms within the Game that anticipate and specifically allow forthe non-commercial transfer of In-Game Items to anyone else for any reason, (4)buy, offer to buy, accept, access or use any other user’s account or In-Game Items,except by using mechanisms within the Game that anticipate and specificallyallow for the non-commercial transfer of In-Game Items, and (5) link to orotherwise endorse or identify any websites, organizations, or persons thatsell, offer to sell, rent, lease, buy, offer to buy, accept, access, trade orotherwise transfer accounts or In-Game Items. You acknowledge that anypurported transfers of Game accounts or In-Game Items in violation of thisTerms, including but not limited to transfers in exchange for money or othercompensation, are void and breach this Terms, and that we have noresponsibility to assist you in connection with completing any suchtransaction. You agree that we have the right to terminate or suspend youraccount and/or your right to access or use the Game if we discover orreasonably believe that you have attempted to buy, sell, rent, lease, license,or transfer your Game account or associated In-Game Items, or used or accessedan account or In-Game Items transferred by another user, or linked to orotherwise endorsed or identified any websites, organizations, or persons thatattempt to buy, sell, rent, lease, license, or transfer accounts or In-GameItems or conducted any other transactions in violation of this Terms.
You agree that we have the right, but not the duty, toreview and monitor all Accounts, all access to our Services, IP addresses,online communications and all content submitted for or included on our Servicesand that we reserve the right to monitor, collect, use, remove, alter, suspendand disclose all such data and content as we, in our sole discretion, believenecessary or appropriate for provision of our Services, to resolve possibleproblems, for any legal process, for compliance with any laws or regulations,to enforce the Terms or in our good faith belief that it would aid inprotecting the rights of any person. You further agree that we have the rightin our sole discretion, without any liability, to remove, suspend or terminateany Accounts that we find objectionable or offensive for any reason, or in theevent of any breach of this Terms without any prior notice.
3. RULES OF CONDUCT/USAGE
You hereby agree to comply with the following rules of conduct/usage whenyou access to and use the Game: (1) you will comply with your obligations tothird party mobile platform providers, including without limitation Apple andGoogle, from whom you download the Game, including any terms regarding paymentfor In-App Purchases made through such platforms; (2) you will not attempt to obtainlogin information or access to another player’s account, collect or harvestpersonal information from any other users for any purpose; (3)you will notexploit, distribute or publicly inform other users of any game error, miscue orbug which provides for an unintended advantage or allows impersonation ofanother person, including by use of automated collection mechanisms such asclear graphics interchange formats, cookies, or similar technology for anypurpose; (4) you will not exploit differences in pricing for In-App Purchasesor In-Game, through arbitrage or in any other manner, by sending altered,deceptive, or false source-identifying information, including but not limitedto, by use of a proxy or spoofed IP addresses or VPNs, or by requesting thatsomeone else make In-App Purchases or purchase In-Game Items on your behalf inorder to take advantage of a difference in pricing; (5) you will not harass,threaten or bully any other player, nor post or submit any abusive,threatening, bullying, harassing, obscene, defamatory, offensive, pornographicor illegal content, or content that infringes or violates the rights of someoneelse, or impersonate any other person; (6) you will not use the Game for anyunauthorized commercial purpose, including but not limited to commercialadvertisement or solicitation (such as chain letters, junk e-mail,"spam" or other repetitive messages), or gathering or transferringIn-Game Items for sale; (7) you will not use the Game for performing in-gameservices for payment, such as leveling up or item collection services; (8) youwill not use or design cheats, exploits, automation software, bots, hacks, modsor any unauthorized software designed to modify or interfere with the Gameexperience; (9) you will not remove or obscure any proprietary notices withinthe Game; (10) you will not to disrupt or attempt to disrupt the Game or anyother person’s use or enjoyment of the Game; (11) you will not attempt to gainunauthorized access to the Game, to accounts registered to others, or tonetworks from which portions of the Game are provided, including bycircumventing or bypassing robot exclusion headers or security mechanisms forthe Game; (12) you will not use any service or software that accesses,intercepts, "mines," or otherwise collects information from the Gameor that is in transit from or to the Game; (13) without our prior writtenconsent, you will not make any automated use of the Game, or take any actionthat imposes an unreasonable burden on our infrastructure in any manner; (14)without our prior written consent, you will not use any software, technology,or device to send content or messages, scrape, spider, or crawl the Game, orharvest or manipulate data from the Game; (15) you will not improperly use oursupport services, including by submitting false reports; (16) except wherepermitted by law or relevant open source licenses, you will not modify, reverseengineer, decompile, disassemble, decipher or otherwise try to derive thesource code for the Game; (17) without our prior written consent you will notcopy, modify or distribute content from the Game; (18) you will not advocate,promote, encourage, or otherwise facilitate any illegal behavior, includingwithout limitation the use of illegal drugs, unlawful gambling or theft. Youagree that your failure to comply with the aforesaid rules of conduct/usage mayresult in the suspension of your account, or any portion of your account,and/or subject you to any of the penalties we deem to be reasonable ornecessary in our sole discretion.
Our Service may provide communication channels such as forums or chatareas ("Communication Channels") designed to enable you tocommunicate with other Service users. We have no obligation to monitor thesecommunication channels but reserves the right, at our sole discretion, toreview information posted to the Communication Channels and to remove anyinformation, at any time, without prior notice, for any reason. We may alsoterminate or suspend your access to any Communication Channels at any time,without prior notice, for any reason. You agree that all your communicationswith the Communication Channels are public and thus you have no expectation ofprivacy regarding your use of the Communication Channels. We are notresponsible for information that you choose to share on the CommunicationChannels, or for the actions of other users.
You agree that your use of the Service shall be lawful and that you willcomply with the usage rules. You agree not to use our Service to transmit orotherwise disseminate information that is obscene, indecent, vulgar, sexual orotherwise objectionable or inappropriate. You agree that we have the right, butnot the obligation, to remove any information you transmit through theCommunication Channels which we deem to be harmful, offensive, or otherwise inviolation of this Terms at any time at our sole discretion.
4. INTERRUPTION OF SERVICES
We reserve the right to interrupt the Services from time to time on aregularly scheduled basis or otherwise with or without prior notice in order toperform maintenance. You agree that our Services may be interrupted forunforeseen circumstances or causes beyond our reasonable control, and we cannotguarantee that you will be able to access our Services or your Account wheneveryou may wish to do so. In any event, we shall not be liable or provide anycompensation for any interruption of the Services arising from unforeseencircumstances or causes beyond our reasonable control.
5. DISCLAIMER OF WARRANTIES
Our Service, the Account and any other game resource of ours is providedto you on an "AS-IS" basis. We provide no warranties or remedies forour Service. You acknowledge that we are not responsible for any damage, loss,liability or result caused by widgets from other developers. We and oursuppliers disclaim all express, implied or statutory warranties relating to theService, including without limitation, merchantability, fitness for aparticular purpose, title, and non-infringement. We do not warrant that use ofthe Service will be uninterrupted, or error-free, that defects will becorrected, or that the Service is free of viruses or other harmful components.
6. LIMITATION OF LIABILITY
Neither we nor our suppliers shall be responsible or liable with respectto any subject matter of this Terms or terms or conditions related theretounder any contract, negligence, strict liability or other theory for loss orinaccuracy of data or cost of procurement of substitute goods, services ortechnology, or for any indirect, incidental or consequential damages including,but not limited to loss of revenues and loss of profits. Our aggregatecumulative liability hereunder shall not exceed the grater of fifty dollars($50.00) or the amount paid by you for the Service that caused such damage.Notwithstanding the foregoing, the exclusion of certain warranties or thelimitation or exclusion of liability may not be permitted by relevant laws incertain instances. Therefore, some of the limitations herein may not apply toyou.
7. TERMINATION
This Terms and the licenses granted hereunder are effective on the dateyou accept this Terms and shall continue unless this Terms is terminatedpursuant to this section. We may suspend or terminate your Account and/oraccess through your Account for an indefinite period of time, terminate yourAccount and/or access through your Account and/or terminate this Termsimmediately and without notice if you breach this Terms or any terms of serviceor privacy policy of any third party platform such as mobile platforms or ifwe, in our sole discretion, believe you to have willfully infringed any thirdparty intellectual property rights, or if we are unable to verify orauthenticate any information you provide to us, and in such case, you will loseaccess to the Services including all game resources and we shall not have anyobligation to refund any fees you paid or provide any other compensation forunused game resources or otherwise have any other liability whatsoever to you.
8.CHOICE OF LAW AND VENUE
This Agreement shall be governed by and construed in accordance with thelaws of the Hong Kong Special Administrative Region of the People’s Republic ofChina without giving effect to conflict of laws principles, and all disputes,controversies or claims arising out of or in connection with this Agreement,including the existence, validity, interpretation, performance, breach ortermination thereof or any dispute regarding non-contractual obligationsarising out of or relating to it, shall be referred to and finally resolved byarbitration administered by the Hong Kong International Arbitration Centre("HKIAC") under the HKIAC Administered Arbitration Rules in forcewhen the Notice of Arbitration is submitted. The number of arbitrators shall bethree. The place of the arbitration shall be Hong Kong. The language ofarbitration shall be English.

If you no longer want Age of Dragons: Empire War to make active use ofyour information, you may send an e-mail to services@ageofdragons-app.com.Place "Delete My Account" in the subject line and include your firstname, last name, e-mail address and user ID number from which you access ourgames (if applicable) in the body of the e-mail. We will respond to yourrequest within thirty (30) days. Age of Dragons: Empire War may use yourinformation unless and until you send Age of Dragons: Empire War such arequest. Please note that your information, for example those records pertainingto payments or customer service matters, may be retained for legal andaccounting purposes. If you have sent or posted content on the Service, we maynot be able to delete it.
